Customer Terms of Service
Customer Terms of Service
Effective date: 11 October 2026
Operated by: MIRABK Company, CR No. 7054866681, National short address RHOA6468 (“Company”, “we”, “us”)
Mirabk is a technology platform that allows you (“Customer”, “you”) to request and book freight/transportation services provided by independent third-party drivers/carriers (“Drivers”). The Company does not itself provide transportation or freight services and does not take custody, possession, or control of your cargo at any point. The transportation service is provided solely by the Driver.
2. Booking & Pricing
- Prices shown in-app include all applicable fees and VAT, disclosed before you confirm a booking, in accordance with the Saudi E-Commerce Law’s pricing transparency requirements.
- You agree to pay the full price shown at time of booking, including any applicable cancellation fee if you cancel after a Driver has been assigned.
3. Cargo Responsibility
- You are responsible for accurately describing the cargo (nature, weight, dimensions, any hazardous/restricted materials) at time of booking.
- You may not book transportation for goods prohibited under Saudi law.
- The Company does not insure your cargo. If you require cargo insurance, you are responsible for arranging it independently, or agreeing insurance terms directly with the Driver/carrier, unless a specific in-app insurance add-on is offered at booking (if none exists, remove this clause).
4. Payment
- Payments are processed via Moyasar, a PCI-DSS compliant provider. The Company does not store your full card details.
- Refunds/cancellations are handled per the cancellation policy shown at booking.
5. Cancellation & Right of Withdrawal
Consistent with the Saudi E-Commerce Law, you may cancel a booking free of charge before a Driver is assigned/dispatched. Once a Driver has been assigned or has begun the trip, cancellation fees as disclosed in-app may apply, since this is a time-sensitive service rather than a returnable good.
6. Liability
To the maximum extent permitted by Saudi law:
- The Company is not liable for cargo loss, damage, or delay occurring during transportation, as the transportation service is provided by the independent Driver, not the Company.
- Claims regarding the transportation service itself should be directed to the Driver/carrier and, where applicable, their insurer.
- The Company is liable only for failures in the matching/booking technology itself (e.g., billing errors on our part).
7. Prohibited Use
You may not use the Platform to transport illegal goods, misrepresent cargo contents, or engage in fraud (including payment fraud or fake bookings).
8. Data Protection
Your personal data is handled per our [Privacy Policy], compliant with the Saudi PDPL.
9. Dispute Resolution & Governing Law
Governed by the laws of the Kingdom of Saudi Arabia; disputes subject to the competent courts of Saudi Arabia, without prejudice to mandatory Saudi consumer-protection rights.
10. Changes
We may update these Terms; continued use after notice constitutes acceptance.

Driver Terms of Service
Driver Terms of Service
Effective date: 11 October 2026
Operated by: MIRABK Company, CR No. 7054866681, National short address RHOA6468 (“Company”, “we”, “us”)
Mirabk is a technology platform that enables independent drivers/carriers (“Drivers”) to connect with customers seeking freight transportation services. We are not a carrier, freight forwarder, or transportation provider. We do not own, lease, or operate any vehicles, and we do not take custody, possession, or control of any cargo at any point. The transportation service itself is provided solely by the Driver, acting as an independent contractor.
This framing mirrors Uber’s Saudi ToS pattern. This clause is only legally sound if it also matches your actual licensing status — see the Freight Broker License flag from research. Do not rely on this language alone as a substitute for confirming licensing status with TGA/counsel.
2. Eligibility & Verification
To use the Platform as a Driver, you must:
- Hold a valid Saudi driving license appropriate to your vehicle class
- Hold a valid vehicle registration (Istimara) for the vehicle used
- Hold any license required by the Transport General Authority (TGA) to operate as a freight carrier, if applicable to your vehicle/cargo type
- Provide accurate identity documentation (national ID/Iqama)
- Meet any additional safety/background requirements we specify
You are solely responsible for maintaining all licenses, registrations, and permits required by Saudi law to lawfully provide transportation/freight services, including any TGA carrier authorization.
3. Independent Contractor Status
You are an independent contractor, not an employee, agent, partner, or representative of the Company. Nothing in these Terms creates an employment relationship. You are responsible for your own:
- Tax obligations (Zakat, income tax as applicable)
- Social insurance (GOSI) registration, if legally required for your status
- Vehicle maintenance and roadworthiness
- Compliance with Saudi Traffic Law and Land Transport regulations
4. Insurance
You must maintain, at your own cost, valid insurance covering:
- Third-party vehicle liability, as mandatory under Saudi law
- Cargo/goods-in-transit insurance appropriate to the freight you carry, if required by TGA regulation or requested by the shipper
The Company does not provide cargo insurance, vehicle insurance, or liability coverage for the transportation service. The Company’s role is limited to providing the matching technology.
5. Payments
- Customers pay via the Platform; the Company (or its payment processor) collects payment and remits your earnings less the applicable service/commission fee, on the payout schedule stated in the app.
- You are responsible for issuing any tax invoices required under Saudi VAT law for your services, if applicable to your registration status.
6. Conduct & Safety
You agree to:
- Provide the transportation service safely, lawfully, and in accordance with Saudi Traffic Law
- Not subcontract a trip to another driver without Platform approval
- Treat customers, their cargo, and their property with due care
- Report accidents, cargo damage, or safety incidents to the Company and relevant authorities as required
7. Liability & Indemnity
To the maximum extent permitted by Saudi law:
- The Company is not liable for cargo loss, damage, delay, or any dispute arising from the transportation service itself, as this is provided by you, not the Company.
- You agree to indemnify the Company against claims arising from your provision of transportation services, including cargo damage, traffic violations, or third-party injury claims, except where caused by the Company’s own proven negligence in operating the matching platform.
8. Suspension & Termination
We may suspend or terminate your account for: expired/invalid licensing, safety violations, fraud, repeated customer complaints, or breach of these Terms.
9. Dispute Resolution & Governing Law
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes shall be subject to the exclusive jurisdiction of the competent courts of Saudi Arabia, without prejudice to any mandatory consumer/labor protections under Saudi law.
10. Changes
We may update these Terms; continued use after notice constitutes acceptance.
